On the bus in the morning rush hour, the property was stolen. Would you ask the driver to stop the car? If you were another passenger, would you be willing to cooperate? Yesterday, Miss Song, a citizen of Fuzhou, posted a microblog saying that a passenger’s mobile phone was stolen while taking No. 118 bus. The driver stopped and closed the door. Many passengers waited for a long time and finally found no thief. Miss Song thought it was normal for the department door to cooperate with the police investigation, but some passengers complained that the driver delayed her working time, and even some passengers pressed the emergency button on the back door of the bus to forcibly get off.
Miss Song told the reporter that at 08:10 A.M. yesterday, she took bus No. 118 to work. When the vehicle was driving to hutoujie Street station in Gulou district, a passenger claimed that her mobile phone had been stolen.
Miss Song said that the person who lost the wallet was a middle-aged woman. When she found the wallet was stolen, she communicated with the driver. The driver closed the door quickly and drove the car to the nearest police station. Miss Song said that the driver explained the situation to everyone at that time. Most passengers were willing to cooperate, but some passengers were impatient.
“After waiting for five to ten minutes, a man shouted that the red button above the back door of the bus could drive the door.” Miss Song said that soon there was a commotion in the car, and some passengers got off after pressing the red button. Finally, the driver drove away at the urging of the remaining passengers.
“I think everyone should understand each other in this situation. If everyone does not cooperate, it will encourage the arrogance of thieves.” Miss Song said. However, some passengers did not think so. Miss Song told the reporter that some people in the car had been complaining that the driver’s practice delayed their working hours, and some passengers shouted that they lost their cell phones and couldn’t find them back, just buy another one, and the passengers accused the person who lost his cell phone “selfish enough to let the vehicle person be late with her”.
Yesterday morning, the reporter contacted Fuzhou Bus Group, which belongs to 118 Road. A staff member of the company said that the driver closed the car door after the company verified that the passenger’s mobile phone was stolen. She said that if a passenger is stolen in the car, the bus company usually closes the door to prevent thieves from escaping, and at the same time explains to the passengers in the car, and then calls the police to deal with it. “Maybe some passengers can’t wait and press emergency switch to get off.” The staff said that if a passenger insisted on getting off the bus, the bus driver had no right to restrict it.
Ding Zhaozeng, an associate professor of law school and master tutor of Fujian Normal University, believes that according to the law, citizens have the obligation to assist judicial organs in detecting criminal cases, and public security organs can ask passengers to stay in the car for protection clues. But before the police came, neither the owner nor the driver had the right to prevent other passengers from getting off the bus. “In this case, if the bus driver stops and closes the door, this practice can be understood, but the consent of other passengers must be obtained. If the bus driver forcibly restricts passengers from getting off the bus, the losses caused by the passengers can be claimed from the owner and the bus company.” Ding Zhaozeng said.
